Business Litigation

Litigation: Business Litigation, Probate Litigation, Real Estate Transactions and Litigation, Criminal Defense, AppealsLeonard W. Buckley, Jr., P.C. regularly represents its business clients in a variety of matters, such as:

Intra-Company Ownership Disputes

Sometimes partners or owners can't get along and must go to Court to resolve their rights in the business property. On some occasions one owner in a small business will "lock-out" the other owner and the only recourse the locked-out owner has is to go to Court.

Collections and Breach of Contract

Whether you sell your products and services to a customer or client and they don't pay you under the terms of the contract, or if you pay someone for their products and they don't deliver, you have legal rights to either be paid, get a refund, recover property, or otherwise enforce your rights. Leonard W. Buckley, Jr., P.C. attorneys regularly appear in court fighting for our clients' rights.

Mechanic's Liens

If your business has provided goods or services to improve or repair real estate, you may be able to enforce a lien against the property. Likewise, some unscrupulous business owners will wrongfully file mechanic's liens and you need to defend yourself.

Evictions

Many leases start out well, but end on bad terms. When a tenant stops paying rent or otherwise breaks the lease, it is difficult to remove them from the property. If you try to forcibly remove them, you may even subject yourself to a lawsuit. Our offices will handle the legal process for you efficiently.

Administrative Matters

Businesses often encounter tax issues with the state, insurance regulatory concerns, licensing issues, and other matters that are not always litigated in the Circuit Court. Some of these matters are resolved before administrative tribunals which have unique procedural requirements.

Probate Litigation

In addition to administration of decedents' estates, guardianship estates, and conservatorship,  we litigate our clients' rights in the probate court concerning:
  • Discovery of Assets - recovering assets that have been removed from estates, or defending your right to property you acquired from a decedent
  • Will Contests- litigating disputes regarding Wills, Trusts, or Deeds that were made because of fraud or duress
  • Determination of Title - For various reasons it may be necessary for a Court to determine title to assets
